SITE REGULATIONS

Chapter I

1. The internet portal to which the selected people are directed by the Newsletter operates at the website www.genata.biz (hereinafter also referred to as the Portal) and presents selected products in the current offer of the Seller and enables establishing commercial relations between the Portal Administrator and the Portal User to sell Products offered by the Portal Administrator through standard distribution channels.

 
2. The Portal manages, manages and administers a company running a business under the name GENATA EUROPEAN GOODS Limited Liability Company spółka komandytowa, ul. Młodzieńcza 14, 03-655 Warszawa entered into the Register of Entrepreneurs District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register KRS number: 0000506169, REGON: 147200363, Tax ID: 5272712757, called the Portal Administrator.
 
3. The Newsletter is addressed only to persons who are employees, co-workers on the basis of any legal relationship of entities conducting business activity, i.e. natural persons conducting business activity, legal persons, and organizational units without legal personality but equipped with legal capacity. Only those authorized to act on behalf of or for the benefit of the entities conducting business activity listed above are allowed to perform the activities in the Portal.

Administrator, to which redirection takes place only after a positive response to the sent Newsletter enabling redirection of the Portal User to the Administrator's merchant or a person coordinating the process of redirecting the Portal User to the appropriate Administrator of the Administrator.
 
4) Newsletter - an electronic version of the bulletin not constituting the Administrator's commercial offer within the meaning of Article 66 or Article 661 of the Civil Code, informing about the currently available Products at the Website Administrator.
 
5) Products - goods offered by the Portal Administrator, in particular food products, household chemicals, hygiene products and others - may be traded, i.e. purchase - sale contracts between the Portal Administrator and the entity represented by the Portal User, in accordance with the law.

Chapter II

Operation Procedures on the website

1. User of the Portal in case of interest in the Products contained in the Newsletter and filling out the relevant form and sending it electronically to e-mail: odo@genata.biz can use the Portal to contact the Coordinator, who will redirect him to the appropriate merchant or directly contact a sales representative responsible for the Region of the Portal User or after completing the order form for the 3rd category of products (beverages, cosmetics, household chemicals), which goes to the Coordinator and then to the relevant merchant. Further activities are performed outside the Portal by email, telephone or otherwise agreed by the parties.

 
2. The prices given in the Newsletter for individual Products are only exemplary net prices, which should not be treated as binding prices. The final price for the Products will result from negotiations and arrangements between the Portal User and the Portal Administrator.

    a) your personal data will be processed in order to correspond with and handle the case to which you are concerned and to pursue claims or defend against such claims - the legal basis is the legitimate interest of PDA in accordance with Art. 6 par. 1 lit f GDPR - ie handling of issues raised by the form, keeping correspondence with interested entities and servicing the matters reported by them.
    b) to submit an offer to enable submission and execution of orders and to conclude contracts for the sale of products offered by PDA via the PDA’s website and allegro (pursuant to Article 6 paragraph 1 letter (b) of the GDPR) - if the inquiry sent by the form contained a request for an offer,

To the extent that the data is processed in order to direct marketing content to you, it will be processed until you withdraw your consent or object to such processing.

Your data will not be transferred to other entities except: IT systems and IT services providers for PDA, entities providing PDA with the services necessary to perform contracts with you, including legal services, postal operators and couriers, banks with regard to PDA payments to some regulated professionals, such as lawyers.

You have the right to: access to the content of personal data, including the request for issuing a copy and requesting their rectification, deletion of personal data (right to be forgotten), restrictions on the processing of personal data, the right to transfer personal data to another administrator, raise objections to the processing of personal data, including profiling, and for direct marketing purposes, to withdraw consent in the event that PDA will process your personal data based on consent, at any time and in any way, without affecting the legality processing, which was made on the basis of consent before its withdrawal. a) Submitting a newsletter to which you subscribed (under Article 6 paragraph 1 letter (a) of the GDPR),
b) marketing of own PDA products or services (Article 6 (1) (f) of the GDPR - our legitimate interest is to inform about our commercial offer,
c) the pursuit of our legitimate interest consisting in the possible determination or pursuing of claims or defense against claims (the legal basis for processing is Article 6 (1) (f) of the GDPR)

2. Your personal data will be kept for the period necessary to achieve the goal for which you agreed, with systematic control of their suitability assessment, no longer than every 3 years from the date of their introduction. To the extent that the data is processed in order to direct marketing content to you, it will be processed until you withdraw your consent or object to such processing. The period of processing personal data may be extended each time for a period of limitation of claims, if the processing of personal data will be necessary to seek possible claims or defend against such claims by ADO. After this period, the data will be processed only to the extent and for the time required by law, including the provisions of tax law and accounting.

In addition to the processing of personal data for purposes arising from the legitimate interests of PDA, you have the right to object to the reasons related to your particular situation.

6. Providing personal data by you is voluntary.

7. Your data can be used in the process of automated data processing, including profiling. The profiling of personal data by PDA involves the processing of your data (also in an automated way), by using them to evaluate some information, in particular to analyze or forecast your personal preferences and interests related to the PDA offer.

    a) Establishment and maintenance of user accounts and services in the PDA domain genata.biz. hereinafter referred to as the SERVICE (pursuant to Article 6 (1) (b) of the GDPR - i.e. the performance of the contract for the provision of electronic services in the scope of the User Account)

    b) enable the submission and execution of orders and the conclusion of contracts for the sale of products offered by PDA via the SERVICE (pursuant to Article 6 paragraph 1 point (b) of the GDPR),

    c) marketing of own PDA products or services (Article 6 (1) (f) of the GDPR - our legitimate interest is to inform about our commercial offer,

    d) to guarantee the security of the online sales services by registering the IP addresses of the SERVICE users (pursuant to Article 6 (1) (f) of the GDPR, our legitimate interest is to ensure the safety of providing services provided electronically),

    e) implementation of our legitimate interest consisting in the possible determination or pursuing of claims or defense against claims (the legal basis for processing is Article 6 (1) (f) of the GDPR)

Your personal data will be kept for the period necessary to achieve the goal for which you have agreed, with systematic control of their suitability assessment, no longer than every 3 years from the date of their introduction. Your data will not be transferred to other entities except: a carrier or intermediary carrying out shipments on behalf of PDA, if when placing an order in the SERVICE you used the method of delivery by post or courier, the entity servicing payments on the Website, if, when placing the order, you used the method of electronic payment or payment card, selected entities supporting marketing campaigns and promotion of offers when you agreed to receive information about rebates and the current offer electronically PDA, IT system providers and IT PDA services to entities providing PDA with the services necessary to perform contracts with you, including legal services, postal operators and couriers, banks in the implementation of payments, to some persons performing regulated professions, such as lawyers.

6. INFORMATIONAL CLAUSE ON CONTRACTOR”S EMPLOYEES

Based on the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (hereinafter referred to as  "GDPR") ") We would like to inform you that:
1. The administrator of your data is GENATA EUROPEAN GOODS Limited Liability Company spółka komandytowa ul. Młodzieńcza, no. 14, 03-655, Warsaw entered into the Register of Entrepreneurs District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register KRS Number: 0000506169, REGON: 147200363, Tax ID: 5272712757, e-mail: odo @ genata.biz, +48 (85) 742 05 46, ul. 16-070 Choroszcz, ul. Warszawska 42, hereinafter referred to as ADO.
2. In all matters related to the processing of your personal data and the exercise of rights due to you on the basis of the GDPR, you can contact the data indicated in point. 1.
3. Your data has been made available to PDA by our contractor, whom you represent / are an employee / co-worker or obtained from public registers (eg business registers, court KRS / CEIDG) in connection with PDA's performance of a commercial agreement combining PDA and the entity you 

represent / which you are an employee / colleague.
4. We will process the following categories of your personal data:
 
a) for persons representing: name / surname and surname, PESEL number, function in the representing body, position, e-mail address, telephone number,
b) for other people: first name and surname, e-mail address, telephone number, position.
 
5. PDA will process your personal data when it is necessary for purposes resulting from legitimate interests pursued by PDA or a third party - pursuant to art. 6 par. 1 point of GDPR - for which the Administrator recognizes: conclusion and performance of a commercial contract linking PDA and the entity you represent / work with, fraud prevention, ensuring the security of the ICT environment, using internal compliance monitoring processes, and determining, investigating and defense against claims.
6. The recipients of your personal data may be entities that provide PDA with services related to the execution of the trade agreement referred to in point. 5, including IT, consultancy, accounting, auditing, IT, mailing, payment, archiving and document destruction services as well as statutory auditors and notaries, as well as competent authorities entitled to receive your data under the law.
7. Your personal data is stored for the time necessary to conclude and execute the trade agreement referred to in paragraph. 5. The storage period will be extended by the period of limitation of claims, if the processing of your data is necessary to establish or assert any claims or defend against such claims by PDA. After these periods, the data will be kept only for the time required by law.
8. You have the right to request access to your personal data from PDA, rectification, deletion or limitation of processing, as well as data transfer.
9. If you do not want us to process your personal data, you can object to the processing of your personal data at any time.
10. You have the right to lodge a complaint to the President of the Office for the Protection of Personal Data.

 

III. COMPLAINTS


1. The Portal User may submit complaints about the operation of the Portal to the Portal Administrator.
 
2. Applications may be submitted in electronic form to the following address: odo@genata.biz on the basis of an appropriate form.
 
3. Only a fully completed complaint form will be subject to recognition.
 
4. Within 14 days from the date of receipt of the complete complaint, the Portal User will be informed in electronic form about whether the complaint has been accepted and about how to settle it to the e-mail address provided in the complaint application.

 

IV. FINAL PROVISIONS


1. Activities performed on the Portal are subject to Polish legislation.
 
2. In matters not covered by law, the provisions of the Civil Code shall apply accordingly.
 
3. The right to introduce changes to these Regulations is provided by the Portal Administrator. 

Information in this regard will be posted on the Portal at least 7 days before the changes are introduced. If the Portal User still wants to use the services offered by the Portal, he will have to accept the new content of the Regulations.
 
4. In the event of a dispute regarding the use of the Portal, the parties will settle amicably in the first place. In the event of failure to reach an agreement under this procedure, the competent court to decide the dispute will be the common court competent for the seat of the Portal Administrator.
 
5. The Portal, as well as the contents contained therein, are protected by law, and all proprietary copyrights to the content contained therein belong to the Portal Administrator.
 
6. The Portal Administrator is not responsible for the content posted by the Portal Users, and thus is not responsible for violation of any rights of third parties, including intellectual property rights, property rights and personal copyrights caused by the inclusion of such content.
